DESIGN ANTHROPIC PRIVACY POLICY

1. Overview

(a) All capitalised words have the same definition as in our Terms of Use unless otherwise stated.

(b) Design Anthropic ABN  (us, we or our) operates the website located at designanthropic.com.au (the Website). We provide interior design services (Services).

(c) We are not bound by the Privacy Act 1988 (Cth) (Privacy Act). However, we take privacy of personal information seriously. Personal information is information or opinions that can be used to reasonably identify an individual.

(d) We will handle personal information that we collect or obtain in connection with the provision of our Website Services and your interactions with us in relation to the Website in accordance with this Privacy Notice (Privacy Notice or Notice).

(e) This Notice also contains information about how you may access and seek correction of your personal information held by us, and how to make complaints about any privacy-related concerns.

(f) If we change this Notice, we will display notice of changes on our Website or otherwise notify you in writing.

(g) If you provide a pseudonym to us or wish to remain anonymous, in the course of accessing our Services, we may not be able to provide you with the full extent of our Services and your use of the Website may be limited.

2. How do we collect your personal information?

(a) We collect personal information through the following avenues:

(i) where you request our Services to be provided to you;

(ii) where you complete a form or registration process in relation to our Services on the Website or otherwise;

(iii) where you inquire or otherwise communicate with us in person, over email or phone, or otherwise;

(iv) where you interact with the Website, through the use of browser ‘cookies’ or trackers;

(v) from time to time, third-party social networking services such as Facebook or Google may provide your personal information to us when you register a User Account by linking to your other account on these third-party social networking services; and

(vi) in such other situations, which we will inform you from time to time, where we collect personal information from you that is reasonably necessary for the proper function of our Services.

3. What personal information do we collect?

(a) The kinds of personal information we may collect from you will depend on your relationship with us and the nature of your interaction with us.

(b) We usually collect the following types of personal information from users:

(i) names, email addresses, physical addresses, phone numbers, geographical information, bank account details, gender, date of birth, ABN or ACN, photographs, opinions or information about meals purchased on the Website; and

(ii) other personal information that you may voluntarily provide to us to assist us to conduct our business and provide our Services.

4. What do we do with your personal information?

(a) We may use and disclose your personal information for the following purposes:

(i) to provide our Services to you, including as part of the course of regular operation of the Website;

(ii) to provide you with further information about our Services you requested;

(iii) to personalise your experience of our Website;

(iv) to respond to feedback and complaints;

(v) for the development of new Services;

(vi) for enforcement of the Terms of Use on our Website;

(vii) for enforcement of contractual agreements for our Services;

5. Do we send your personal information to parties outside Australia?

(a) We use third-party service providers for digital cloud storage, web hosting or other technology-related services in connection with operating our business and providing our Services. 

(b) We disclose your personal information to, and store your personal information with, these third party services providers who may operate outside of Australia, or operate in Australia with servers located outside of Australia. As some of these third-party service providers operate globally, we cannot say with certainty where their servers are located or the countries out of which they operate at any given time. Further, these locations may be subject to change without notice to us.

6. Are we responsible for third parties websites and social media links?

This Notice applies solely to personal information collected with regard to our Website. We are not responsible for the collection of information and/or privacy practices of any other third party websites that may be linked to from our Website from time-to-time, or social media accounts or websites (e.g. Linkedin, Facebook, Twitter, YouTube) accessed via links on our Website or emails. We refer you to the privacy policies and terms of use of those relevant third parties.

7. Choosing not to provide personal data

(a) You can choose not to provide us with any personal data. However, if you do this, we will not be able to provide you with any products or services

(b) However, you can continue to use our site and browse the pages of our site.

8. How do we use your personal information for direct marketing?

(a) Subject to receiving your consent, your personal information may be used to offer you new products and services, notify you of new developments to our existing Services, or any other promotional communication related to our Services.

(b) If you do not wish to receive direct marketing communications from us, you may opt out at any time by clicking a link on the email communications sent to you or contacting us as set out in section 26.

9. How do we use cookies and analytics?

(a) During your access to or use of our Website we may collect information about your computer or mobile device, page visits and internet connections using persistent cookies. We may use persistent cookies in the future. We will collect this non-personal information in order to improve the operation of our Website, direct the most appropriate content to you, and to remember your preferences for the next time you access our Website. 

(b) We may use third party vendors such as Google Analytics to collect non-personal information about visitor traffic to our Website as part of our information gathering processes (see www.google.com/analytics/ for details). The data available to us through Google Analytics is aggregated only and does not identify you personally. You may opt out of Google’s use of cookies by installing the opt-out browser add-on here: https://tools.google.com/dlpage/gaoptout.

(c) You are able to opt out of cookie technology through changing the settings on your browser.

(d) We will not facilitate the merging of personally-identifiable information with non-personally identifiable information collected from cookies and analytics.

(e) In the event third party advertisements are placed on our Website, third-party advertisers or ad servers may place or recognise a unique cookie on your browser. We are not responsible for the use of cookies by such third party advertisers or ad servers and we refer you to their own respective privacy policies.

10. Accessing information we hold about you

(a) We will provide you with the information within 30 days of your request, unless doing so would adversely affect the rights and freedoms of others (e.g., another person’s confidentiality or intellectual property rights).

(b) We will tell you if we can't comply with your request and why.

11. Inaccurate information

You can contact us to request that we correct any information we hold about you that you believe is inaccurate.

 

12. Objections to using data for profiling or automated decisions

We may analyse your data to determine the products and services that are most relevant to you, such as tailoring our emails based on your behavior. However, we will not use your data for any automated decisions that could significantly impact you without your explicit consent or where required or authorised by Australian law. The primary purpose of using your data is to provide our products and services to you effectively.

13. The right to be forgotten

(a) You have the right to request that your data to be erased.

(b) This means we have to delete all information that we hold about you, except to the extent of any information we are required to hold due to our legal obligations.

(b) If you are not satisfied with our response to your complaint, you may seek a review by contacting the Office of the Australian Information Commissioner.

15. How do we keep personal information secure? 

(a) You should be aware that there are inherent risks associated with the transmission of information via the Internet. Data security measures can never be guaranteed. This means that while we take steps to protect your personal information, we cannot guarantee its security.

(b) If you suspect any misuse or loss or unauthorised access, modification or disclosure of personal information that you have provided to us, please contact us immediately.

16. Will we transfer your personal information?

If we are involved in a sale, merger, consolidation, change in control, transfer of substantial assets, reorganisation or liquidation, we may transfer, sell or assign your personal information collected by us to one or more relevant third parties at our discretion. Otherwise, we will not sell or trade your personal information to any third party, organisations, or individuals without your consent.

17. Where do we store data?

(a) We use service providers based in Australia. If we transfer personal data outside of Australia, we will ensure that your privacy rights are adequately protected by ensuring these service providers have the same or similar measures in place to protect data shared.  

18. How long do we store data?

(a) We will retain your data for as long as it is reasonably necessary for the purposes for which it was collected, and as required by Australian law. The specific retention period will depend on your interactions with us.

(b) If you have made a purchase, we will keep a record of your purchase for the period necessary to fulfill our invoicing and tax obligations as mandated by Australian tax laws.

(c) Once we no longer require your information for the stated purposes, we will securely delete it or anonymise any data that is no longer necessary, in accordance with applicable Australian privacy regulations.

19. Third parties who access your data

(a) We share data with third parties in the following circumstances: 

(i) Other companies in our group of companies, as necessary to operate our Site 

(ii) Our suppliers and service providers working for us e.g. payment processors 

(iii) Our professional and legal advisors 

(iv) Third parties engaged in fraud prevention and detection 

(v)  Law enforcement or other government authorities 

(b)      Share with third parties who enable us to provide our products and services, which may include: 

(i) Payment processors such as Xero and Stripe who may process your payment for any products and services bought from us; 

(ii) Social media and analytics such as Facebook, Instagram, and Google Adwords for custom audience generation and the development of targeting criteria; 

(iii) Other third parties such as Zoom, Dubsado for processing and holding Data that enables us to ensure you are kept informed of all course information, logins and marketing material, offers, promotions, newsletters, blogs, and video training. 

(iv) Where we have your consent to do so or otherwise where we are legally permitted to do so.

20. Payment security

(a) All of our real-time credit card authorisations are handled by secure third-party gateway providers and these are secured by the highest level of security. The following measures are taken to protect your data: 

(i) Payments are fully automated with an immediate response. 

(ii) Your complete credit card number cannot be viewed by us or any outside party. 

(iii) All transaction data is encrypted for storage within our third-party gateway suppliers' bank-grade data centre, further protecting your credit card data. 

(iv) Our third-party gateway provider is an authorised third-party processor for all the major Australian banks. 

(v) Our third-party gateway provider will at no time touch your funds; all monies are directly transferred from your credit card to the merchant account held by us. 

(b) We use third-party gateway providers that are widely respected for providing secure and reliable online payment solutions. We have chosen to deal with the best so you can feel safe that your personal information is kept safe and secure at all times. While we attempt to protect the information in our possession, no security system is perfect, and we cannot promise that information about you will remain secure in all circumstances. 

(c) The Payment Card Industry Data Security Standard (PCI DSS) is an information security standard for all organisations that handle branded credit cards from major card schemes. PCI DSS is a standard mandated by the card brands like Visa, Mastercard, American Express and Discover and is managed by the PCI Security Standards Council. 

(d) PCI-DSS requirements help ensure the secure handling of credit card information through our Site and the service providers. 

21. Age of consent

By using this site, you warrant that you are at least the age of majority in your State or Territory of residence. Our Site should not be used by anyone under the age of majority, and we do not knowingly collect data from anyone under the age of majority.

22. Cookies and how to block them

(a) Our Site uses cookies and similar technologies to provide certain functionality to our Site. “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. Cookies can also be used to analyse traffic and for advertising and marketing purposes. They do not harm your systems and the HELP function in your browser will tell you how to restrict or block the cookies.  

(b) You can turn off cookies by activating the setting in your browser that allows you to do this. You can also delete cookies through your browser settings.  For more information about cookies, and how to disable cookies, visit http://www.allaboutcookies.org. If you use browser settings to block all cookies, you may not be able to access all or parts of our Site.

23. Web beacons

(a) We may use web beacons (or clear gifs) on our website and in our emails.  We send emails, we can track behaviour such as who opened the emails, who clicked the links and collect information such as your ip address, your browser or email type, we then put this information together to improve the performance of our email campaigns and provide you with better and/or services specific to your needs.

(b) You will always have the ability to opt out of any emails we send just click the link in the email that says “unsubscribe”.

24. Governing law

This Privacy Policy and your use of this Site is governed in all respects by the laws of Australia.

25. Updates to our privacy policy

(a) Please make sure to check in on our Privacy Policy periodically, as we may update this Privacy Policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.

(b) We will always ensure that the current date of the Privacy Policy also known as the “Effective Date” is prominently displayed at the very top of this Privacy Policy, so you know it's the latest version.

(ii) wish to request access to any personal information that we hold;

(iii) wish to correct or update your personal information that we hold; or

(b) We reserve the right to charge for reasonable expenses that we may incur in preparing and sending you a copy of your personal information.

(c) If you have a complaint or a privacy-related concern, please give us the opportunity to resolve matters by contacting us first by email. Once we have received a complaint, we will try to work with you to resolve the matter.
